Photo Contest: Rules, Terms and Conditions

Best Bubble Parties invites you to enter its Best Bubble Photo Contest. You must read the following rules, terms and legal conditions before submitting any photos!

The voting portion of the Best Bubble Parties 2014-2015 Digital Photo Contest (the “Contest”) is open to everyone except employees of Best Bubble Parties and the immediate families of such employees.

However, in order to enter a picture for a chance at both the Grand Prize and the People’s Choice Award for most votes, you must have attended or hosted a Best Bubble Party (Indoor, Outdoor, Indoor/Outdoor Combo, or Assemblies ONLY!) and your picture must be from the party you attended or hosted.

WHAT TO ENTER:

We are looking for fun and engaging captured images celebrating the special relationship between children, birthdays, special events, and most of all… bubbles.

Entrants must not submit images that infringe on the rights of any other photographer or person.

All photographs should accurately reflect the subject matter and the scene as it appeared. Photos that have been digitally altered beyond standard optimization (removal of dust, cropping, reasonable adjustments to exposure, color and contrast, etc.) will be disqualified.

Photo captions must accompany all submissions, and should include the subject of the image, the location the image was taken, and the name of the photographer(s).

HOW TO ENTER:

All images must be submitted though our new and improved photo contest submission page. Complete all required fields, including name, email and other information about your photo submission.

You can select an image directly from your computer desktop, or submit images from Flickr, Facebook and Instagram for consideration in the contest. 

Digital images that are sent via mail or email will not be accepted except at the discretion of the Best Bubble Parties Management Team.

ELIGIBILITY AND JUDGING:

Submissions may be watermarked if desired, but the watermark should be inconspicuous enough to not interfere with the judging of the photo. A watermarked photo might not be honored by the competition (at the judges sole discretion) if the photographer is unable or unavailable to provide a pristine, watermark-free version of the image when asked.

One overall winner will be selected randomly from among all the applicants.

The other will be selected through a peer voting system, where everyone who logs in to our website will be allowed a single vote towards a particular picture of their choice.

In the case of any controversy, Best Bubble Parties shall determine winner eligibility in its sole and absolute discretion. All decisions made are final.

DEADLINES:

Online entries can be uploaded through our Best Bubble Parties Photo Contest Web Page.

Public voting for the People’s-Choice prize winner will be held for at least a three-week period at a date to be announced on the main website.

All winners will be announced on the website and receive email and phone call notifications.

Best Bubble Parties reserves the right to adjust any deadline(s) as the result of causes beyond its immediate control.

WINNING PHOTOS:

For the Monthly Grand Prize, a random photo will be selected as the big winner on the appointed date.

The People’s Choice Winner will be determined by popular vote from a pool of all entries.

Note: There is a limit of one vote per person and any noticeable inconsistencies in voting may lead to disqualification at the sole discretion of Best Bubble Parties and their management team.

YOUR RIGHTS:

All photographs will be featured in a Photo Contest folder on the Best Bubble Parties website and will be eligible for a variety of future contests and peer voting competitions.

If you wish to retain all rights to any photograph you submit, please let us know — including ownership if applicable. Otherwise, by submitting your photo into our contest you grant Best Bubble Parties a royalty-free, nonexclusive right, in perpetuity, to:

• Use the photograph on the Internet as a part of our Photo Contest.
• Use the photograph in Best Bubble Parties’ non-commercial communications.
• Provide your photograph to other individuals and organizations for non-commercial use, such as in news stories, newsletters, web displays, Google adwords display banners and the like.
• Use, in connection with the Photo Contest, your first name and city of residence.
• Keep the files provided so that your photos can be entered into the next month’s contest and used to support our mission of promoting safe, fun, and amazing children’s bubble entertainment.

Photo Contest: Legal Conditions

By entering this contest, you agree to certain all of the terms and conditions relating to this contest and you are responsible for understanding your rights.

By entering, participants agree to indemnify, defend and hold harmless Best Bubble Parties, its respective subsidiaries, affiliates, directors, officers, employees, attorneys, agents and representatives, from any and all third party liability for any injuries, loss, claim, action, demand or damage of any kind arising from or in connection with the competition (collectively, “Losses”), including without limitation any third party claim for copyright infringement or a violation of an individual’s right to privacy and/or publicity right. The Contest is void where prohibited by law.

Each entrant in the Contest (each a “Entrant”) is responsible for ensuring that he or she has the right to submit the photos that he or she submits to the Contest per these rules.

You agree that any and all disputes that cannot be resolved with Best Bubble Parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, before a court of competent jurisdiction located in Los Angeles, California which court shall apply the laws of California without regard for rules of conflicts of law. IN ANY SUCH DISPUTE, PARTICIPANT SHALL NOT BE ENTITLED TO ANY PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES, OR ANY DAMAGES OTHER THAN PARTICIPANT’S ACTUAL OUT-OF-POCKET EXPENSES (IF ANY) ASSOCIATED WITH PARTICIPATING IN THE CONTEST. YOU HEREBY WAIVE ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED. The Contest and Best Bubble Parties’ website are provided “as is” without warranty of any kind, either express or implied.

Best Bubble Parties is not responsible for any incorrect or inaccurate information, whether caused by website users or by any equipment or programming associated with or utilized in the photo competition, or by any technical or human error that may occur in the processing of submissions to the photo competition, including but not limited to any misprints or typographical errors. Best Bubble Parties assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Best Bubble Parties is not responsible for any problems or technical malfunction of any telephone network or lines, computer equipment, servers, providers, computer on-line systems, software, or failure of email on account of technical problems or traffic congestion on the Internet or at any website, including injury or damage to participant’s or to any other person’s computer related to or resulting from participating or uploading images or information in the photo contest.

 

If, for any reason, the photo competition is not capable of completion as planned, including but not limited to, any reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Best Bubble Parties that corrupt or affect the administration, security, fairness, integrity or proper conduct of the photo competition, Best Bubble Parties reserves the right at its sole discretion to cancel, terminate, modify or suspend the photo competition.
